1. Agreement
These Terms of Service ("Terms") govern your access to and use of Growth OS, a software service operated by ExceloWeb Solution LLC ("we", "us"). By creating an account or using the service, you agree to these Terms.
2. The service
Growth OS provides marketing tools for retail businesses, including AI-assisted content generation, scheduling, email and SMS campaigns, review management, and customer relationship management. Features available to you depend on your subscription plan.
3. Accounts & organizations
You are responsible for the activity that occurs under your account and organization, and for keeping your credentials secure. Each organization's data is isolated; you may only access data belonging to organizations you are a member of.
4. Acceptable use
You agree not to use Growth OS to send unlawful, deceptive, or unsolicited messages. You are solely responsible for ensuring your email and SMS campaigns comply with applicable laws, including the CAN-SPAM Act and TCPA. You must honor all opt-out and unsubscribe requests promptly.
5. SMS & messaging
SMS sending requires carrier registration (A2P 10DLC) and may be unavailable until that approval is complete. Recipients can opt out at any time by replying STOP. You are responsible for maintaining valid consent for every contact you message.
6. Subscriptions & billing
Paid plans are billed in advance on a recurring basis through our payment processor, Stripe. You can upgrade, downgrade, or cancel at any time from the billing portal. Fees are non-refundable except where required by law.
7. AI-generated content
Content produced by AI features is a starting point and may contain inaccuracies. You are responsible for reviewing and approving all content before it is published or sent.
8. Termination
We may suspend or terminate access for violations of these Terms. You may stop using the service and cancel your subscription at any time.
9. Disclaimers & liability
The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, ExceloWeb Solution LLC is not liable for indirect or consequential damages arising from your use of the service.
